TERMS OF SERVICE

PREAMBLE

These Terms of Service (hereinafter "ToS") define the terms and conditions of use of the services offered on the website resumory.com (hereinafter "the Website" or "the Platform"), as well as the rights and obligations of the parties.

The Website is published by Gautier Colasse, sole proprietor, hereinafter referred to as "the Publisher" or "Resumory."

By accessing and using the Website, the User acknowledges having read these ToS and expressly accepts them without reservation.

ARTICLE 1 – DEFINITIONS

For the purposes of these ToS, the following terms shall have the meanings set out below:

  • "User": any natural or legal person who accesses the Website and uses the Services.
  • "Services": all features made available by Resumory, including AI-assisted resume and cover letter creation.
  • "Account": the User's personal space created upon registration, granting access to the Services.
  • "User Content": any data, text, image, or document uploaded or created by the User on the Platform.
  • "Credits": consumption units allowing use of the Service's artificial intelligence features.

ARTICLE 2 – PURPOSE

These ToS govern access to and use of the website resumory.com, which offers an AI-assisted resume and cover letter creation platform. The Services include:

  • Creating and customizing resumes
  • Generating cover letters through AI-assisted conversation
  • Extracting and analyzing documents (existing resumes, job postings)
  • Generating professional photos with AI
  • Exporting documents in PDF and image formats

ARTICLE 3 – ACCESS TO THE WEBSITE AND SERVICES

3.1 Access Conditions

Access to the Website is free. Use of certain Services requires creating an Account and may be subject to a paid subscription or a Credit system.

The User must be at least 16 years old to create an Account. Minors under 16 must obtain authorization from their legal guardians.

3.2 Registration

To access all Services, the User must create an Account by providing accurate and complete information, including:

  • A valid email address
  • A secure password (minimum 8 characters)
  • First and last name

The User agrees to keep this information up to date and to maintain the confidentiality of their login credentials. The User is solely responsible for the use made of their Account.

3.3 Availability

The Publisher endeavors to ensure access to the Website 24 hours a day, 7 days a week. However, access may be temporarily suspended for maintenance, updates, or any other technical reason, without the Publisher being held liable.

ARTICLE 4 – SERVICES AND PRICING

4.1 Free Plan

The free plan includes:

  • 30 initial AI credits upon registration
  • 30 AI credits offered each month
  • Access to basic resume creation features
  • Standard quality PDF export
  • Documents limited to one page

4.2 Premium Plan

The Premium subscription offers extended features:

  • 1,000 initial AI credits
  • 1,000 AI credits per month
  • High-quality PDF export
  • Multi-page documents
  • Signature feature
  • Priority access to new features

4.3 Credit System

Credits are consumed based on the following usage:

  • AI chat messages: 1 credit
  • Professional photo generation: 50 credits
  • Content generation (letters): 5 credits
  • Document extraction: 5 credits
  • Job posting analysis: 10 credits

Unused Credits do not carry over from one month to the next, unless otherwise stated.

4.4 Payments and Billing

Payments are processed securely by Lemon Squeezy. The User can manage their subscription directly from their personal account and, depending on the purchase, via Lemon Squeezy's customer portal.

Prices are displayed in euros, all taxes included. The Publisher reserves the right to modify prices at any time, with Users being notified of any change at least 30 days before it takes effect.

4.5 Refund Policy

Payments are processed by Lemon Squeezy (merchant of record). If you are a consumer, you may have statutory cancellation or withdrawal rights depending on your country of residence. Refund and cancellation requests are handled in accordance with the Lemon Squeezy Buyer Terms. Refunds are reviewed on a case-by-case basis and may be refused in cases of fraud, refund abuse, or other manipulative behavior, as described in the same terms.

How to request a refund. Please use the contact form and include your account email and the transaction reference from your receipt, use the support link available in your Lemon Squeezy receipt, or sign in to Lemon Squeezy My Orders.

Refund processing. Approved refunds are issued to the original payment method. Processing times vary depending on banks and payment methods.

ARTICLE 5 – INTELLECTUAL PROPERTY

5.1 Publisher's Property

The Website, its architecture, visual identity, texts, images, audio elements, software, and databases are the exclusive property of the Publisher and are protected by French and international intellectual property laws.

Any reproduction, representation, modification, publication, or adaptation of all or part of the Website elements is strictly prohibited without prior written authorization from the Publisher.

5.2 User-Generated Content

The User retains intellectual property rights over the content they create and upload to the Platform, including their resumes and cover letters.

By using the Services, the User grants the Publisher a non-exclusive, free, and worldwide license to host, display, and technically process this content solely for the purpose of providing the Services.

5.3 AI-Generated Content

Content generated by the Platform's artificial intelligence tools (texts, suggestions, photos) may be freely used by the User for personal and professional purposes.

The User acknowledges that this content is automatically generated and that it is their responsibility to verify and adapt it according to their needs.

ARTICLE 6 – LIABILITY

6.1 Publisher's Liability

The Publisher commits to implementing all necessary means to ensure the continuity and quality of the Services. Its liability is limited to an obligation of means.

The Publisher shall not be held liable for:

  • Service interruptions related to maintenance or circumstances beyond its control
  • The accuracy of content generated by artificial intelligence
  • The use made by the User of documents created on the Platform
  • Indirect damages resulting from the use or inability to use the Services

6.2 User's Liability

The User is solely responsible for:

  • The accuracy and truthfulness of the information they provide
  • The use they make of the Services and generated documents
  • Respecting third-party rights in the content they upload
  • Securing their login credentials

ARTICLE 7 – USER OBLIGATIONS

The User agrees to:

  • Use the Services in accordance with their intended purpose and these ToS
  • Not compromise the security of the Website or attempt to access unauthorized areas
  • Not use the Services for illegal purposes or purposes contrary to public order
  • Not upload illegal, defamatory content or content infringing third-party rights
  • Not use automated systems to access the Services abusively
  • Respect the usage limits provided by their subscription

ARTICLE 8 – PERSONAL DATA PROTECTION

The Publisher collects and processes personal data in accordance with its Privacy Policy, available on the Website, and in compliance with the General Data Protection Regulation (GDPR).

The User has rights regarding their personal data, which they can exercise by contacting the Publisher via the contact form.

ARTICLE 9 – TERMINATION

9.1 Termination by the User

The User may delete their Account at any time from their personal space or by sending a request via the contact form.

In the case of an active subscription, termination will take effect at the end of the paid period. Any refund request will be handled in accordance with the Lemon Squeezy Buyer Terms.

9.2 Termination by the Publisher

The Publisher reserves the right to suspend or terminate a User's Account, without notice or compensation, in the event of:

  • Violation of these ToS
  • Fraudulent or abusive use of the Services
  • Providing false or misleading information
  • Behavior detrimental to the interests of the Publisher or other Users

ARTICLE 10 – RIGHT OF WITHDRAWAL

If you are a consumer, you may have a statutory right of withdrawal depending on your country of residence. Without prejudice to any mandatory rights, refund requests are handled in accordance with the Lemon Squeezy Buyer Terms and are reviewed on a case-by-case basis.

ARTICLE 11 – LIMITATION OF LIABILITY

To the extent permitted by applicable law, the total liability of the Publisher, for all causes combined, shall not exceed the total amount paid by the User during the twelve (12) months preceding the event giving rise to liability.

This limitation does not apply in cases of intentional misconduct or gross negligence by the Publisher.

ARTICLE 12 – AMENDMENT OF THE ToS

The Publisher reserves the right to modify these ToS at any time. Users will be informed of any modification by email or by notification on the Website.

Continued use of the Services after the modifications take effect constitutes acceptance of the new ToS.

ARTICLE 13 – GOVERNING LAW AND JURISDICTION

These ToS are governed by French law.

In the event of a dispute relating to the interpretation or performance of these terms, the parties shall endeavor to find an amicable solution. Failing that, the dispute shall be brought before the competent courts of Paris, unless mandatory legal provisions dictate otherwise.
